The laws of every state specify situations for writing a final will and testomony. The entire drift of our law is towards the absolute prohibition of all ideas that diverge within the slightest from the accepted platitudes, and behind that drift of law there’s a much more potent force of growing custom, and below that customized there’s a national philosophy which erects conformity into the noblest of virtues and the free functioning of persona into a capital crime towards society.

Whatever disadvantages connect to a system of unwritten law, and of these we are totally sensible, it has at least this advantage, that its elasticity allows those that administer it to adapt it to the various circumstances of society, and to the requirements and habits of the age by which we live, so as to avoid the inconsistencies and injustice which come up when the law is not in harmony with the desires and usages and pursuits of the era to which it’s instantly utilized.
